It's a black day for Sabbath. Tony Iommi seems to be exploiting the talent of his erstwhile band mate by operating to the 'letter of the law'.
He might consider the idea of Prior Art in continuing to derive benefit from the co-work and images of others, he might also consider who owns the copyright to images of themselves.
This is not to 'cock a snook' at Iommi's entitlement as the rights owner of the Black Sabbath name since 1985.
As anyone with a passing interest in heavy rock will know though, Ozzy through his TV shows has broadened awareness of Black Sabbath far beyond the cult adulation that Iommi deservedly gets from the heavy rock scene. To deny that his not benefiting from this in some way is rather disingenuous.
More intriguing is his motivation. Why would a fellow band member wish to exploit and put at risk the group and long standing associations? Does the money matter THAT much? or is there, as always, alot more to it!

This was expected, seeing the success Iommi and co. made with Dio under the name of "heaven and hell". I must agree with the Sharon factor have been inserted into all this.
In my opinion this has nothing to do with fame and exploiting the name by Iommi, because it has been mentioned million of times that Iommi is the owner of the name of Black Sabbath. Why now?

Hi RR, to answer your question, yes is the answer. All know how Sharon is a very powerful woman in the rock n'roll/heavy metal scene. I remeber an interview with a band participating in one of the ozzfest a couple of years ago. He said it literally: Now one can say no to Sharon!
Another example is what happened with Iron Maiden when she setup the egg throwing thing, which only gives us one conclusion: it is difficult to see someone related to Ozzy doing better than Ozzy.
I was happy to see Dio-Sabbath came out under the name Heaven and Hell, while keeping the original lineup, and it is not important to record a new album, because looking back in the past couple of years did not give any hope - check Sharon and Ozzy interview when the latter was asked if a new Sabbath album will see the day, Sharon was furious and put bad remarks about Sabbath.
All this, in my opinion, is an evidence of one thing: no should be bigger than Ozzy Osbourne, no one should steel the lights to another band related to Ozzy or a band participating in the same venue as Ozzy.
I don't want to be misunderstood, I love Ozzy and his solo career, I love his albums such as bark at the moon, ultimate sin, even Down to Earth (a lot did not like that one), but sadly such moves ruins the enjoyment.
Ozzy should think twice about what he said, in fact he should ask himself the same questions. Those guys are in their 60's, instead, shouldn't they maintain the glory of old and today?
I apologize for nagging that much, but thought of sharing all my thoughts here.
